These Terms of Service are entered into by and between you and Catalogue LLC ("Catalogue," "we," or "us"). The following terms and conditions govern your access to and use of [www.catalogue.land] ("Website") and the Catalogue home swapping platform and service for cat owners (the "Platform") operated through the Website, whether as a Website or Platform visitor or other user ("Visitor") or as a registered Member of the Platform. The Platform and the Website are referred to collectively in these Terms of Service as the "Services." We refer to Visitors and Members as "Users" and "you" in these Terms of Service.

By "Member" we mean as applicable (i) the cat owner / host (the "Host") of a stay (a "Stay") arranged through the Platform or (ii) the guest / cat sitter (the "Guest") who will homesit and look after Host's home and cat(s). You must be a registered Member in order to access the Platform.

While many of the terms in these Terms of Service apply to all Users, a significant portion apply solely to Members. Please read them carefully to understand your rights and responsibilities.

The Services are offered and available to users who are 18 years of age or older and reside in the United States. By using the Services, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services.

Acceptance of the Terms of Service By using the Services or by clicking to agree to the Terms of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms of Service. If you do not want to agree to these Terms of Service, you must not access or use the Services.

Changes to the Terms of Service We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms of Service means that you accept and agree to the changes.

Stay Agreements Are Between Members When you arrange a Stay through the Services, you are entering into an agreement directly with the Host or Guest, as applicable. We are not party to this agreement. It is your responsibility to ensure the agreement meets your needs and does not violate these Terms of Service. All Stay-related requirements in these Terms are incorporated into your individual Stay agreement.

Services We Provide Through the Platform The Platform connects cat owners to facilitate Stays. In exchange for your Membership Fee (see section "Membership Fees") and compliance with these Terms, we provide:

  • The ability to create and manage Listings

  • Member messaging tools

  • Stay arrangements between Members

  • Review features

  • Platform rules and baseline expectations

  • Additional support as we may offer from time to time

Catalogue Does Not Verify or Vet Members Members are solely responsible for vetting others. Catalogue does not conduct background checks or verifications. You must conduct your own due diligence.

Stays May Only Be Canceled For Extenuating Circumstances Members may cancel a Stay with at least 90 days' notice. Cancellations with less notice must result from extenuating circumstances (e.g., illness, emergencies, etc.). Otherwise, damages may apply under your Stay agreement.

Members Must Maintain Appropriate Insurance You must maintain appropriate insurance coverage during any Stay. We do not offer insurance or provide advice on what coverage is suitable. It is your responsibility to assess your needs and obtain proper coverage.

Additional Requirements for Stays Members agree to comply with the following:

All Members:

  • Provide honest and complete information

  • Communicate promptly and respectfully

  • Abide by all applicable laws

Hosts:

  • Provide a clean, safe, and habitable home

  • Leave clear care instructions for your cat(s)

  • Ensure access to necessary supplies

Guests:

  • Treat the Host’s home with care and respect

  • Follow care instructions for the cat(s)

  • Report any issues promptly

Membership Fees Membership fees are required to access the Platform. They are shown during enrollment and renew automatically. You must maintain an up-to-date payment method. We may increase fees for future terms.

Canceling Your Membership Membership fees are non-refundable. You can disable auto-renewal through your Member profile or by contacting us with at least 7 days’ notice. You cannot cancel during any period in which you have a scheduled Stay.

Accessing the Services and Account Security You must provide accurate registration information. You are responsible for maintaining the confidentiality of your login details. We reserve the right to disable any account at our sole discretion.

Intellectual Property Rights Catalogue owns all rights in the Services and related materials. You may not use, copy, or distribute any materials without our express written consent, except for your personal, non-commercial use.

Prohibited Uses You may not use the Services for illegal purposes, to harm others, or in any way that violates applicable law. This includes but is not limited to fraudulent activity, impersonation, hacking, or disrupting the Platform.

User Contributions You may post content ("User Contributions") on the Platform. By posting, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display your content for the purpose of operating and promoting the Platform.

You represent that you own or control the rights to your contributions and that they comply with these Terms. We may remove any content that violates our policies.

Content Standards User Contributions must not:

  • Violate any law

  • Contain hateful, explicit, or violent content

  • Infringe others’ rights

  • Deceive or impersonate

  • Promote illegal activity

Copyright Infringement If you believe content on our Platform infringes your copyright, please contact us.

Failure to Comply We may suspend or terminate your access to the Services if you violate these Terms. We may also pursue legal remedies or cooperate with law enforcement as necessary.

Reliance on Information Posted We do not guarantee the accuracy of materials posted by others, including Listings or reviews. You rely on such content at your own risk.

Changes to the Services We may update the Services at any time. We are not obligated to update content that may be outdated.

Linking to the Services and Third Parties You may link to our homepage fairly and legally. We are not responsible for third-party links on the Platform.

Geographic Restrictions The Services are intended for users in the United States. If you access the Services from outside the U.S., you do so at your own risk.

Disclaimer of Warranties and Limitation of Liability THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES. WE DISCLAIM LIABILITY FOR:

  • MEMBER ACTIONS OR OMISSIONS

  • PROPERTY OR PERSONAL INJURY

  • CANCELLATIONS

  • INDIRECT DAMAGES

OUR TOTAL LIABILITY WILL NOT EXCEED $100 OR THE AMOUNT PAID BY YOU IN THE PRIOR 12 MONTHS.

Indemnification You agree to indemnify and hold harmless Catalogue from any claims arising from your use of the Services or your violation of these Terms.

Governing Law and Jurisdiction These Terms are governed by California law. Legal disputes must be brought in courts located in Los Angeles County, California.

Waiver and Severability No waiver of any term is a further waiver. If a provision is unenforceable, it will be limited or removed, and the rest of the Terms will remain in effect.

Entire Agreement These Terms are the entire agreement between you and Catalogue and supersede prior understandings.
